Validity

These General Terms and Conditions apply to all offers from Code Excursion. These can be viewed on the Code Excursion website. Validity of these Terms and Conditions: from April 2019.

Payment of Course Fee

Verbal or written registration obligates you to pay the course fee. Payment must be made within seven days of course registration (payment receipt). Otherwise, the reservation of the course place cannot be guaranteed. However, non-payment does not constitute cancellation, and non-payment or non-participation in the course does not release you from the obligation to pay the course fee. This is subject to the provision that you independently find a replacement participant who pays the course fee.

Course Organization

We always strive to offer you a great program. We reserve the right to postpone courses for important organizational reasons, to combine them, or to shorten them with proportional refund of the course fee, as well as to change the venue. If an instructor is unavailable in instructor-led courses, we may change instructors or appoint a substitute (this does not apply to webinars). Of course, we ensure high professional competence for all instructors.

Course Places and Implementation

To conduct our courses under optimal conditions, we set a minimum and maximum number of participants for each learning offer. Course places are allocated in the order of registration, subject to payment within the payment deadline. If there are insufficient participants, the course may not be held. In this case, the course fee will be waived or refunded. In case of under-enrollment of a course, it may happen that we still hold the course if participants agree to accept an increased course fee or a reduced number of sessions.

Course Exclusion

We reserve the right to exclude course participants from a course. In cases where the participant is at fault, the entire course fee is still due even upon exclusion. In cases without fault, a refund will be made, whereby lessons already attended will be deducted pro rata. An exclusion always occurs with justification. Possible reasons are non-payment of the course fee as well as other serious cases, such as defamation, harassment, or intentional property damage.

Cancellations

Every registration is binding. If you succeed in finding a new participant as a replacement after cancellation, we will naturally waive the course fee – possibly minus an administration fee of CHF 25.– or refund you the already paid course fee.

Missed Lessons

Missed lessons cannot be made up and will not be refunded. However, for webinars, it is possible to catch up on the lessons at home yourself. After completion of the group course, it is also possible to continue the webinars yourself for one year after the course start using the access link.

Course Confirmation

At the end and after attending at least 80 percent of the course lessons, we are happy to issue you a course confirmation upon request. Terms of Use and Copyright, Disclaimer for Third-Party Offers. The teaching materials of Code Excursion are protected by copyright. They may only be used by participants personally for information purposes. Any other form of use, in particular reproduction, making publicly available, duplication, or modification – whether in electronic or printed form – is only permitted with written permission from Code Excursion. Regarding the use of webinar content and any other content or offers from third parties, we expressly refer to their respective applicable Terms and Conditions. Code Excursion cannot be held liable for any resulting use. The legal relationship is established between the participant and the third parties.

Photos, Video and Audio Recordings

By registering for the course, you agree that photos as well as video and audio recordings may be made of you and may be used on social media, on our website, and other related media of Code Excursion and its sponsors. Additionally, publications may occur in newspapers, magazines, and other print media, on television, radio, and in all forms of digital media (including emails and newsletters, internet and social media) and/or in communications for promotional and advertising purposes/or marketing purposes for Code Excursion or one of our partners. Upon request, you will receive digital copies of all photo or video materials in which you and/or your project work appear, if available. Please let us know on the first day of the course if we should not take pictures and video recordings of you.

Insurance

For all courses and events organized by Code Excursion, we exclude all liability for personal injury, property damage, consequential financial damage, or pure financial loss. You are therefore fully responsible for adequate insurance coverage. The use of the facilities in which the courses are held is at your own risk. Code Excursion cannot be held liable for theft and loss of items during the courses.

Liability for Links

Code Excursion has no influence on the design and content of third-party websites. Should illegal content be found on websites that are linked or otherwise used by Code Excursion, we will remove the connection to these offers as soon as possible after becoming aware of the illegality.

Data Protection

Data Protection We process the data that you give us during registration, during the course, or on other occasions (e.g., events), or that we receive about you in this context, with the utmost care and in accordance with Swiss data protection rules. You agree that the mentioned data may be used for personalized advertising campaigns by Code Excursion (e.g., notices about other offers). You also agree that we may pass on the data to partners and sponsors of Code Excursion, who may use it for personalized advertising campaigns or similar purposes. We also share your data with partner companies that provide services for us, e.g., with our partners who provide courses. This is necessary, among other things, so that you can be activated for the courses.

Program and Price Changes

Program and price changes as well as changes to the General Terms and Conditions are reserved. The prices of webinars or other content will be adjusted if the respective providers significantly increase their prices.

Jurisdiction

Swiss law applies to all legal relationships with Code Excursion. The place of jurisdiction is the registered office of Code Excursion in St. Gallen, Canton of St. Gallen.
